These Terms and Conditions ("Terms") govern your use of the 360 AV Design Contractor Time Tracking App ("App"), provided by 360 AV Design ("Company," "we," "us," or "our"). By accessing or using the App, you ("Contractor," "User," or "you") agree to comply with these Terms. If you do not agree, you must not use the App.
1. Acceptance of Terms
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to these Terms, along with our Privacy Policy. The App is designed to track work hours, verify job site attendance via GPS and photo verification, and facilitate payroll processing.
2. Eligibility
● You must be at least 18 years old and legally authorized to work in the United States.
● You must be an approved contractor or employee of 360 AV Design or its clients.
● Misrepresentation of identity or work status may result in termination of access and legal action.
3. Account Registration & Security
● You must provide accurate registration details (name, email, phone number, etc.).
● You are responsible for maintaining account security (password, device access).
● Notify 360 AV Design immediately of unauthorized account activity.
4. GPS & Photo Verification
● Geolocation Tracking: The App requires real-time GPS access to verify your presence at designated job sites.
● Photo Verification: You must take time-stamped photos during clock-in/clock-out, including:
○ Your face (for identity verification).
○ The job site surroundings (for location validation).
● Failure to provide accurate verification may result in time entry rejection or payment delays.
5. Data Collection & Privacy
We collect:
● GPS location data.
● Time-stamped photos.
● Work hours, job site details, and device information.
Data is used for:
● Time tracking, payroll processing, and compliance.
● Fraud prevention and dispute resolution.

6. Payment & Payroll
● The App tracks work hours but does not guarantee payment—compensation is subject to 360 AV Design’s payroll policies.
● Discrepancies in logged hours must be reported within 7 days.
● Taxes and deductions are the Contractor’s responsibility (if classified as 1099).
7. Prohibited Conduct
You agree not to:
● Falsify location, time entries, or photos.
● Use the App for unauthorized purposes.
● Share your account or bypass security measures.
● Reverse-engineer or modify the App.
8. Termination
● 360 AV Design may suspend or terminate access for violations.
● You may delete your account, but logged data may be retained for legal/compliance reasons.
9. Limitation of Liability
The App is provided "as-is"—we do not guarantee uninterrupted or error-free service.
360 AV Design is not liable for:
● Incorrect payments due to user error.
● GPS/photo verification failures.
● Third-party issues (device malfunctions, network errors).
10. Governing Law & Disputes
● These Terms are governed by Texas law.
● Disputes will be resolved in Houston, Texas courts.
11. Changes to Terms
We may update these Terms; continued use constitutes acceptance.
